PRIVACY POLICY AND YOUR PRIVACY RIGHTS
In this Privacy Policy (“Policy”), PERCEEV (“we”, “our”, “us”) a California corporation, describes the personal information that we collect from visitors to and users of our websites (“Sites”), our blogs, our mobile Apps (“Applications”), and our online products and services (collectively, “Services”) and how we collect, use, and share personal information in the course of our business activities.
If, during the Services, we collect your personal information on behalf of a third party, such as one of our customers who is an event organizer OR official timing company through which you register for the event (“our Client”/”Client”), this will be brought to your attention at the time you provide your personal information. The information collected on behalf of the third party may include: name, gender, city, bib number, type of event, age group, email address or club name. This Policy does not cover our Clients’ use of your personal information outside of our Services. We are not responsible for the privacy practices of our Clients, as such we encourage you to read their respective privacy statements.
We will only collect, use, and share your personal information where we are satisfied that we have an appropriate legal basis to do so. The information below summarizes the sources from which that information was collected, the types and categories of personal information we collect, how we use and share the personal information, and the legal basis for our use of such personal information.
HOW WE COLLECT YOUR INFORMATION
PERCEEV collects your Information from the following sources, but not limited to:
- We collect information you provide to us when you request, purchase products, or services for us
- We collect information through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, including when you visit our sites and applications or use our applications on third-party sites or platforms using one or more devices, whether or not you are logged in or registered.
- We collect information using analytics tools, including when you visit our sites and applications or use our applications on third-party sites or platforms.
- When you use a 3rd party service “timing company” that allows the collection of data from an RFID transponder and/or Bluetooth technology to obtain the data of each participant.
- When you opt-in to partake in a competition, game, promotional offer, survey, on our Sites or the Mobile Apps.
- When you are on a forum or chat service or contact us in any form and ask questions relating to any of our Services or during customer support inquiries.
TYPE AND CATEGORIES OF PERSONAL INFORMATION WE COLLECT
We may have collected the following categories of personal information:
- Registration information you provide when you create an account, enter a promotion, or link your profile on a third-party site or platform with your registration account, such as your first name and surname, user media profile, facial recognition, country of residence, gender, date of birth, email address, username, and password;
- Customer Records: username, password, club group, or participation in specific events
- Protected Classification Characteristics: height, weight, gender, gender identity, country/national origin
- Internet or other similar network activity: websites visits, including where you came in from, login details, pages you visited, duration of your visit, geographic
- Information you provide in public forums on our sites and applications, such as your public posts;
- Information sent either one-to-one or within a limited group using our message, chat, post, or similar functionality, where we are permitted by applicable law to collect this information;
- Information we obtain from a third party, such as a site or platform provider, about use of our applications on third-party platforms or devices;
- Location information, including precise or approximate location information provided by a mobile or other device interacting with one of our sites, applications, or physical properties (including through beacon technologies), or associated with your IP address or other online or device identifier, where we are permitted by law to process this information;
- Activity information about your use, and the use by any person(s) you authorize through your account of our sites and applications, such as the content you view or post, how often you use our services, and your preferences;
- Usage, viewing, technical, and device data when you visit our sites, use our applications on third-party sites or platforms, or open emails we send, or connect with our wireless Internet access services and other similar technologies, including your browser or device type, unique device identifier, and IP address;
- Still or video images captured by cameras or readers on or around events that use our technology at physical locations, and/or the links you click.
- Technical data collected includes your browser type and operating system, device data, your Internet Protocol (“IP”) address, and your unique ID, which is given to each visitor, and expiration date of the ID
- Geolocation: precise geolocation is collected when users opt-in to this feature in our Services
HOW WE USE YOUR INFORMATION
The Information we collect is used to:
- Provide you with the experiences, products, and services you request, view, engage with, or purchase;
- Improve website or app performance;
- Provide a better user experience which will include personalization of content catered to you through your history of usage of Perceev’s Services;
- To create new products and services based on feedback and usage history;
- Monitor and improve our Services and Mobile App; we run analytics and statistics to make the solution better.
- Provide you with targeted advertising based on your activity on our sites and applications and on third-party sites and applications;
- Communicate with you using the Services, Mobile app or platform:
- To receive “Athlete Notifications” when you track the participant on the app. You will also automatically receive event notifications as well as participant notification.
- Technical support or customer service;
- Notification and resolution of potential service outage.
- Remember you and your personal history for easier access to Mobile Apps or websites, as well as safety to protect against fraud;
- Improve location based service for tracking and optimization;
- Send out marketing newsletters;
For reporting and other uses of anonymized data; anonymized data (also known as de-identified information or aggregated non-personal data) is not personal information. Anonymized or de-identified data may be used as follows:
- To Compile analytics and statistics on app or service performance, crashes, errors and bugs to help app or services be more efficient or run smoother;
- Provide analytics and statistics for marketing purposes, such as: number of downloads, the average number of sessions on the app or services during a live event, duration on the app per session, most page visited, most watch person.
LEGAL BASIS FOR USING THE DATA
Our legal basis for using this data includes:
- Your consent, performance of a contract so you can create and manage your account, our legitimate interests which include to improve our Sites and Services, to better engage with you, prevent fraud, and secure our Sites, and to comply with a legal obligation (to keep information we are required to keep).
SHARING PERSONAL INFORMATION WITH 3RD PARTIES
We may disclose your personal information to a third party for a business purpose. We may share your personal information with the following categories of third parties:
- Identifiers: Clients, marketing service providers, data hosting solutions.

- Protected Classification Characteristics: Clients, marketing service providers, data hosting solutions.
- Internet or other similar network activity: Analytics and business intelligence vendors; marketing service providers, data hosting solutions.

- When we work with service providers performing services on our behalf; however, these companies are prohibited from using your personal information for purposes other than those requested by us or required by law;

In addition to the third parties described above, PERCEEV may also disclose your personal information as follows:
- if PERCEEV is required by law or in an emergency to pass on your personal data to public authorities; or
- if a reorganization or a transfer of business ownership takes place at PERCEEV as a result PERCEEV is required to furnish personal data to new management or organization.
RETENTION PERIODS
PERCEEV will generally retain information about you for so long as we have a legal or business purpose for it or a legal requirement to maintain it. The criteria used to determine our retention periods include:
- The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you are a client with us or keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your personal information to address issues that may arise;

PERCEEV’s privacy policy does not apply to websites or apps of third parties, also PERCEEV’s policy does not apply if PERCEEV has placed a hyperlink to that other website on its Websites or in its Apps.

While no method of transmitting or storing data is completely secure, we continually monitor our systems and use all commercially reasonable methods to keep personal information securely in our files and systems. You can review, correct or update most of your personal data by logging into your account, PERCEEV’s website for event creation and management, and/or PERCEEV’S Mobile App. You can request PERCEEV to also change or remove the data by submitting an email to: [email protected]. PERCEEV may be required by law to keep certain personal data and PERCEEV cannot remove or update that personal data at your request. Please bear in mind that, after we update or remove your data at your request, that data may be present in our backups for some time until those backups are also deleted. You may also have the right to object to the processing of your data, request restriction of the processing of your data, request a transfer of your data or withdraw consent to use your data. PERCEEV sometimes processes personal data at the instruction of its customers. PERCEEV has no control over the personal data processed by PERCEEV’s customers themselves. PERCEEV therefore cannot change any competition results and other data on the website of an event in which you have taken part. You may contact the organizer of the event with a request to inspect, update or correct such data.
CALIFORNIA CONSUMER PRIVACY RIGHTS AND CHOICES
California residents and residents of other states may have certain rights in connection with the personal information we collect about you, many of which are subject to exceptions under applicable law:
The right to access and disclosure.
You may have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.
The right to deletion.
You may have the right to request that we delete the personal information we have collected from you.
Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide our Services to you. If you ask us to delete it, you may no longer be able to access or use our Services.
The right to correct.
You may have the right to request that Perceev correct any inaccurate personal information we may hold about you. We will use commercially reasonable efforts to correct inaccurate personal information, taking into account the nature of the personal information and the purpose for our processing. To the extent the information is controlled by one of our customers, we will direct you to our customer to exercise those rights as appropriate.

For security purposes, we may need to verify your identity – in part by requesting certain information from you — when you request to exercise your privacy rights.
